The purpose of the present general terms and conditions of use (hereinafter referred to as ” GTCU “) is to provide a legal framework for the provision of the application and services by KELINDI SAS and to define the conditions of access to and use of the services by the “User” of Heloa.The present GTCU are accessible on the application under the heading “GTCU“. Any use of the application implies the User’s unreserved and unrestricted acceptance of these GCU. By accessing the application for the first time, each User expressly accepts the present GTU. In the event of non-acceptance of the GCU stipulated in the present contract, the User must renounce access to the services offered by the application. KELINDI SAS reserves the right to unilaterally modify the content of these GCU at any time.

ARTICLE 2: Data collection

‍The application ensures that the User’s personal information is collected and processed with respect for privacy in accordance with the French Data Protection Act no. 78-17 of January 6, 1978. This means that only data strictly necessary for the operation of the application and our services will be collected. In accordance with the French Data Protection Act of January 6, 1978, the User has the right to access, rectify, delete and object to his or her personal data. The User may exercise this right by contacting us by e-mail at [email protected]. If you stop using the application for 36 months, your data will be archived for a further 24 months, then automatically deleted to guarantee your right to be forgotten. ARTICLE 3 : Access to the application

The Heloa application provides the User with free access to the following services:
  • Learn to recognize the stages of child development;
  • Record the information required for the child’s medical follow-up;
  • Refer the User to his attending physician.
The application is accessible free of charge from any location to any User with Internet access. All costs incurred by the User in accessing the service (hardware, software, Internet connection, etc.) are at the User’s expense. Non-member Users do not have access to reserved services. To do so, they must register by filling in the form. By agreeing to register for the reserved services, the member User undertakes to provide truthful and accurate information concerning his civil status and contact details, in particular his e-mail address. To access the services, the User must then identify himself using his login and password. Any User who is a regularly registered member may also request to unsubscribe by going to the dedicated page on his personal space. This will take effect within a reasonable time. Heloa shall not be held liable for any event of force majeure resulting in a malfunction of the application or server, subject to any interruption or modification for maintenance purposes. In such cases, the User agrees not to hold the publisher responsible for any interruption or suspension of service, even without prior notice. The User may contact the publisher by e-mail at the publisher’s e-mail address given in ARTICLE 1.

ARTICLE 4: Liability

‍The application is provided free of charge, as is, solely for information purposes to help raise awareness and guide the User on child development, the up-to-date nature of the information and content made available in this application, or their suitability for particular purposes, are not guaranteed. The User acknowledges that the application, including the test and other information it contains, in no way constitutes advice, a recommendation, an examination, a diagnosis, a prescription, or any other act of a medical nature, in particular established or carried out by a doctor or pharmacist. Use of the application and its content in no way replaces the necessary advice given by your doctor or pharmacist or any other healthcare professional competent in each particular case. Any examination or decision by the User must be carried out or made independently on the basis of the relevant scientific and clinical information, in consultation with a competent physician. The information provided within the scope of the application serves as first-level information only. The absence of a warning about a risk does not mean that it does not exist.

ARTICLE 5: Intellectual property

‍Trademarks, logos, signs and all application content (text, images, sound, etc.) are protected by the French Intellectual Property Code and, more specifically, by copyright. Heloa and kelindi are trademarks of KELINDI SAS. The User must request prior authorization from the application for any reproduction, publication or copy of the various contents. The User undertakes to use the contents of the application in a strictly private context. Any use for commercial or advertising purposes is strictly forbidden. Any total or partial representation of this application by any process whatsoever, without the express authorization of the application operator, constitutes an infringement punishable by article L 335-2 et seq. of the French Intellectual Property Code. In accordance with article L122-5 of the French Intellectual Property Code, Users who reproduce, copy or publish protected content must cite the author and source.

ARTICLE 6: Hypertext links

‍Hypertext links may be present on the application. The User is informed that by clicking on these links, he/she will leave the application. The latter has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content.

ARTICLE 7: Cookies

‍The User is informed of our use of cookies when they first visit the application.Cookies are small files stored temporarily on the hard disk of the User’s computer by your browser and which are necessary for the application to function correctly. Cookies do not contain any personal information and are not used to track anyone. A cookie contains a unique, randomly generated identifier. The use of this cookie is subject to the User’s consent. In the absence of acceptance, the User is informed that he/she will not be able to use the application.

ARTICLE 8: Applicable law and jurisdiction

‍French law applies to this contract. In the event of failure to reach an amicable settlement of a dispute between the parties, the French courts shall have sole jurisdiction.For any question relating to the application of these GCU, you may contact the publisher at the address given in ARTICLE 1.
